Important California Proposition 65 — Compliance Information for Retailers
What's Prop 65?
We Inform you about the California's Safe Drinking Water and Toxic Enforcement Act of 1986, Cal. Health & Safety Code section 25249.5, et seq. and its corresponding "Clear and Reasonable Warning" regulations, 27 CCR § 25601 et seq., commonly referred to as Prop 65.
What is "The Products"
Customers who wish to apply for an account are requested to ensure compliance with Prop 65 by affixing the provided warning labels to all products indicated on our website or in an invoice ("The Products"). "The Products" that will be subject to Prop 65 will be clearly indicated. Your invoice will also clearly indicate which products are covered.
Warning Labels
All "The Products" require a Prop 65 warning label to be placed in a prominent and conspicuous location next to the barcode on the outside packaging for the Products.
For the "Products" that are currently in your inventory, we will enclose the warning labels. Please ensure that the warning labels are affixed to any Products for sale to California consumers ASAP.
Please continue to place warning labels on any new inventory of the "Products" that you receive.
You can contact us at any time to replenish the warning labels.
Selling by online
To the extent you offer any "The Products" for sale over the internet to California consumers, your website must display the same warning content as the product label by either including the warning itself or a clearly marked hyperlink using the word "WARNING" to the product page with a link to the warning, or prominently displaying the warning to purchasers before checkout.
Sign-back
When applying for an account, you are required to upload a signed agreement document regarding Prop 65 to the application form.
Less than 10 employees
If your company has 10 or fewer employees, you don't need to put stickers on your products or post online warnings. Please note that this is not the number of employees at each store but the total number of employees. However, as a distributor with more than 10 employees, we need to require a sign-back document from the store to ship the product, so we ask for your cooperation.
Designphil products
It is not possible to test all products at once, so we super conservatively choose "The Products", even those with extremely small amounts of the substance, that might not be subject to PROP65, resulting in many products being subject to PROP65. Designphil is testing Midori, MD, and TRC products. We plan to update "The Products" as soon as the test results are available. Until then, please use the current list.
